Jack Smith Referred for Criminal Indictment, Disbarment Over Trump Lawfare Cases
"It’s no surprise Smith didn’t play by the rules. His cases were always about vengeance — not justice.”
We are living through an era of American history that will go down as one of the most corrupt in the nation’s history.
One of the figures who is emblematic of the obscene weaponization of the U.S. government to target the left’s political enemies is former Special Counsel Jack Smith.
Smith presided over two concocted lawfare cases that were tailor-made to interfere in the 2024 presidential election. He was unconstitutionally appointed and carried out hatchet attacks on the former president at the behest of his mentally decrepit boss Joe Biden and his shadow cabal, which called for taking out Trump ‘by any means necessary.’
Now, Jack Smith is facing a reckoning — and a looming criminal indictment.
Former special counsel Jack Smith — the man behind two failed prosecutions of President Trump — is now the subject of a professional misconduct probe and potential disbarment.
Smith, a longtime Democratic-aligned prosecutor with a track record of botched, overturned prosecutions, had no problem flouting the law as long as it served the right political purpose. He indicted Trump in a blatantly rushed, partisan case and then retreated when faced with a real legal fight.
If you come for the king, you best not miss. And now, calls for Smith’s disbarment have been formally lodged with both the Tennessee Board of Professional Responsibility and the New York Attorney Grievance Committee. The Department of Justice’s Office of Professional Responsibility is conducting an investigation.
The accusations? Illegally spying on sitting members of Congress. Secretly subpoenaing their phone records. And using the Department of Justice as a partisan weapon against conservatives.
A blistering letter sent Friday to Attorney General Pam Bondi, led by Sen. Marsha Blackburn, outlines the scope of Smith’s abuses. The signatories, which include GOP senators Lindsey Graham, Josh Hawley, and Ron Johnson, allege that Smith’s team seized their phone metadata from January 4–7, 2021, without legal justification.
The data collection included call times, recipients, locations, and durations — an unprecedented intrusion into the private communications of elected lawmakers.
“We have yet to learn of any legal predicate for the Biden Department of Justice issuing subpoenas to obtain these cell phone records,” the lawmakers wrote, characterizing the surveillance as politically motivated and constitutionally offensive.
Their conclusion is chilling: Smith and his team targeted them not because of any criminal wrongdoing, but because they were Republicans who supported Donald Trump.
Smith’s cases against Trump collapsed in disgrace. His classified documents case was tossed by a federal judge who ruled his appointment unlawful. The 2020 election case was dropped after Trump won re-election. Now, as more records come to light, we’re learning that Smith’s office wasn’t just incompetent — it was corrupt.
Under the FBI’s so-called “Arctic Frost” investigation, which later fed directly into Smith’s case, the Biden FBI collected tolling data on eight Republican senators and one GOP congressman. This was no rogue operation. It had high-level coordination and apparent White House involvement.
Among those targeted: Sens. Marsha Blackburn, Lindsey Graham, Josh Hawley, Ron Johnson, Bill Hagerty, Dan Sullivan, Tommy Tuberville, and Cynthia Lummis. Rep. Mike Kelly of Pennsylvania was also affected. According to whistleblower documents and Senate Judiciary Chairman Chuck Grassley, Smith took over the Arctic Frost probe in November 2022 — and used it to build his failed elector case against Trump.
“This is arguably worse than Watergate,” Grassley said, accusing the FBI and Smith’s team of violating constitutional limits and weaponizing the DOJ.
The Arctic Frost investigation appears to have been the blueprint for institutionalized political repression. FBI agents reportedly stalked Rep. Scott Perry, tracked his locations, and later seized his phone. Records released by Grassley show that 92 conservative individuals and organizations were swept up in Arctic Frost — including Turning Point USA and its late founder, Charlie Kirk.
This was not about justice. This was about silencing opposition.
Senator Chuck Grassley, who has been leading the Arctic Frost oversight effort since 2022, summed it up:
“Jack Smith and his merry band of DOJ partisans weaponized the justice system to put President Trump and his defense team at an unfair disadvantage. It’s no surprise Smith didn’t play by the rules. His cases were always about vengeance — not justice.”
Indeed, Americans saw through the lawfare. They rejected Smith’s crusade at the ballot box by re-electing Donald Trump. But that alone isn’t enough. The rule of law must be restored, and rogue actors like Jack Smith must be held accountable.
